Terms of Service — Beta

These Terms of Service (“Terms”) govern your use of the Sprigly open beta and the spriglyapp.com website (together, “the Service”), provided by Konstantin Siegel (“we”, “us”). By using the Service, you agree to these Terms.
1. Who we are

2. Eligibility
You must be at least 16 years old to use the Service.
3. The Service
Sprigly is a personal budgeting tool. During the beta it is free of charge: there is no account to create, no sign-in, and no subscription or purchase of any kind. Your budgeting data is stored locally on your device and never reaches us. The app works with no network connection. What little data we handle is described in our beta Privacy Policy.
Sprigly is free while it is in beta. The full release is intended to be a paid app. We will tell you the terms before that happens, and nothing here obliges you to pay anything for the beta or converts into a paid plan by itself.
Sprigly is a budgeting aid, not financial, tax, or investment advice. You are responsible for the accuracy of the data you enter and any decisions based on it.
4. This is beta software
You are using a pre-release version of Sprigly, provided so that you can try it and tell us what is wrong with it. It is likely to contain errors, unfinished features, and behaviour that changes between releases. In particular:
- A beta release can lose or corrupt your data. Because we hold no copy, data lost on your device is gone. Export your data regularly — see section 6.
- Features may change, be replaced, or be removed before the full release.
- We may change or end the beta at any time, without notice and without liability to you. Ending the beta does not delete anything from your device.
- Data you create in the beta may not carry over to the full release, though we will try to make it do so.
Section 9 (disclaimer of warranties) and section 10 (limitation of liability) apply with particular force to beta software. Your mandatory statutory rights as a consumer remain unaffected.
5. Licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial budgeting. You may not copy, modify, reverse-engineer, resell, or sublicense the app (except where mandatory law allows), use it unlawfully, or attempt to disrupt or gain unauthorised access to the Service.
6. Your data and backups
Your budgeting data is stored on your device and we keep no copy of it anywhere. That means you alone are responsible for safeguarding it, including keeping your own backups. Use Settings → Export data to save a copy you control, and do so regularly — especially during the beta (section 4).
We are not liable for data loss from device failure, uninstalling, clearing app data, or factory resets. Device-level backups are governed by your device and Google settings, not by us.
7. Acceptable use
You agree not to use the Service to violate any law, transmit malware, infringe intellectual property, harass others, or interfere with the Service’s operation or security.
8. Feedback and bug reports
If you send us a bug report or other feedback, you allow us to use it to diagnose and fix problems and to improve Sprigly. Please do not include anything confidential you would not want us to read. What a bug report contains, and how we handle it, is described in section 5 of the beta Privacy Policy.
9. Intellectual property
The Service, including its name, logo, design, and code, is owned by us or our licensors. These Terms grant you a licence to use it, not ownership. Your own budgeting data remains yours.
10. Disclaimer of warranties
The Service is provided “as is” and “as available”. To the extent permitted by law, we do not warrant it will be uninterrupted or error-free — and, this being a beta, we positively expect that it will not be. Mandatory statutory warranty and guarantee rights you have as a consumer remain unaffected.
11. Limitation of liability
To the extent permitted by law:
- We are liable without limit for damage caused intentionally or by gross negligence, and for injury to life, body, or health.
- For slight negligence, our liability is limited to the extent permitted by applicable law.
- We are not otherwise liable for indirect or consequential damage, lost profits, or for data loss where you failed to keep reasonable backups (section 6).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
12. Termination
You may stop using the Service at any time by uninstalling the app. There is no account to close and no subscription to cancel. To remove your data first, see Delete Your Data.
We may end the beta, or stop distributing the app, at any time (section 4). Because there is no account and no server, we have no way to suspend an individual user’s access; if you breach these Terms, our remedies are those available to us under the law and under Google Play’s terms. Sections that by nature survive (intellectual property, liability, governing law) survive termination.
13. Website
Use of the spriglyapp.com website is also subject to these Terms. We may change or discontinue website content at any time. The website may link to third-party sites (e.g. Google Play); we are not responsible for their content.
14. Governing law and jurisdiction
These Terms are governed by the laws of the country in which the provider is established, without regard to its conflict-of-law rules. Mandatory consumer-protection rules of your country of residence remain unaffected. As a consumer, you may also bring claims in the courts of your residence.
We are not obliged and not willing to participate in dispute-resolution proceedings before a consumer arbitration board.
15. Changes to these Terms
We may update these Terms as the beta evolves. We will update the “Last updated” date and notify you of material changes. When Sprigly leaves beta, the full-release Terms of Service will apply instead — we will tell you before that happens.
