Terms of Service

These Terms of Service (“Terms”) govern your use of the Sprigly app and the spriglyapp.com website (together, “the Service”), provided by Konstantin Siegel (“we”, “us”). By using the Service, you agree to these Terms.

1. Who we are

2. Eligibility

You must be at least 16 years old to use the Service.

3. The Service

Sprigly is a personal budgeting tool. Your data is stored locally on your device; we do not host or process it on our servers (see the Privacy Policy).

Sprigly is a budgeting aid, not financial, tax, or investment advice. You are responsible for the accuracy of the data you enter and any decisions based on it.

The app is currently provided free of charge.

4. Licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial budgeting. You may not copy, modify, reverse-engineer, resell, or sublicense the app (except where mandatory law allows), use it unlawfully, or attempt to disrupt or gain unauthorised access to the Service.

5. Your data and backups

Because data is stored on your device, you are responsible for safeguarding it, including keeping your own backups. We are not liable for data loss from device failure, uninstalling, clearing app data, or factory resets. Device-level backups are governed by your device and Google settings, not by us.

6. Acceptable use

You agree not to use the Service to violate any law, transmit malware, infringe intellectual property, harass others, or interfere with the Service’s operation or security.

7. Intellectual property

The Service, including its name, logo, design, and code, is owned by us or our licensors. These Terms grant you a licence to use it, not ownership. Your own budgeting data remains yours.

8. Disclaimer of warranties

The Service is provided “as is” and “as available”. To the extent permitted by law, we do not warrant it will be uninterrupted or error-free. Mandatory statutory warranty and guarantee rights for consumers under Austrian and EU law (KSchG, ABGB) remain unaffected.

9. Limitation of liability

To the extent permitted by law:

  • We are liable without limit for damage caused intentionally or by gross negligence, and for injury to life, body, or health.
  • For slight negligence, our liability towards consumers is limited as far as Austrian law permits; liability for slight negligence is excluded towards entrepreneurs (Unternehmer).
  • We are not otherwise liable for indirect or consequential damage, lost profits, or for data loss where you failed to keep reasonable backups (Section 5).

Nothing excludes liability that cannot be excluded by law, including under the Austrian Product Liability Act (Produkthaftungsgesetz).

10. Termination

You may stop using the Service at any time by uninstalling the app. We may suspend or terminate access if you breach these Terms. Sections that by nature survive (IP, liability, governing law) survive termination.

11. Website

Use of the spriglyapp.com website is also subject to these Terms. We may change or discontinue website content at any time. The website may link to third-party sites (e.g. Google Play); we are not responsible for their content.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Austria, excluding the UN CISG and conflict-of-law rules. Mandatory consumer-protection rules of your country of residence remain unaffected. As a consumer, you may also bring claims in the courts of your residence.

EU ODR: https://ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute-resolution proceedings before a consumer arbitration board.

13. Changes to these Terms

We may update these Terms as the Service evolves (for example, when subscriptions launch). We will update the “Last updated” date and notify you of material changes.
