Terms of Service

These Terms of Service (“Terms”) govern your use of the Sprigly app and the spriglyapp.com website (together, “the Service”), provided by Konstantin Siegel (“we”, “us”). By using the Service, you agree to these Terms.

1. Who we are

2. Eligibility

You must be at least 16 years old to use the Service. If you are under the age of majority where you live, you may only take out a subscription with the consent of a parent or guardian who agrees to these Terms.

3. The Service

Sprigly is a personal budgeting tool. Your budgeting data is stored locally on your device. To use Sprigly you create an account (you sign in with your email) and take out a subscription to unlock the app — see sections 4 and 5. We process a limited amount of account and subscription data as described in our Privacy Policy.

Sprigly is a budgeting aid, not financial, tax, or investment advice. You are responsible for the accuracy of the data you enter and any decisions based on it.

4. Your account

You sign in with your email address using a one-time code instead of a password. You agree to provide an email address you control and to keep it accessible, and you are responsible for activity that takes place through your account. Sprigly limits the number of devices that can be signed in to one account at the same time; signing in on a new device may sign you out elsewhere. Your account is for your personal use and is not transferable.

5. Subscriptions and payments

  • Subscription required. Unlocking the app requires a paid subscription. The price and billing period are shown to you in the app store before you buy.
  • Free trial. The Monthly and Annual plans include a 14-day free trial. You will not be charged if you cancel before the trial ends; otherwise it converts automatically into a paid subscription at the price shown, and the auto-renewal terms below apply. The Lifetime plan is a one-time purchase with no trial. Trials are managed through Google Play.
  • Billing through Google Play. Subscriptions are sold and processed by Google Play, which acts as the seller. We never receive your card or payment details. Your purchase is also subject to Google Play’s terms.
  • Auto-renewal. Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the current period ends. Your payment method is charged at each renewal.
  • Cancelling. You can manage or cancel your subscription at any time in your Google Play account settings. Cancelling stops future renewals; you keep access until the end of the period you have already paid for.
  • Refunds. Refunds — including any owed when you exercise a valid withdrawal part-way through a period — are handled under Google Play’s refund policy.
  • Price changes. If we change the price, we will give you advance notice. The new price applies to renewals after the notice; if you do not agree, you can cancel before it takes effect.
  • EU/EEA right of withdrawal. As a consumer in the EU/EEA you normally have 14 days to withdraw from a distance contract for a digital service. By purchasing and gaining immediate access, you expressly request that performance begin at once and acknowledge that you lose your right of withdrawal once the service has been fully provided. Where Google Play is the seller, withdrawal and refunds are handled through Google Play. Your mandatory statutory consumer rights remain unaffected.
When Sprigly launches on iOS, purchases made there will be sold and processed by the Apple App Store under Apple’s terms, and the equivalent store rules will apply.

6. Licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial budgeting. You may not copy, modify, reverse-engineer, resell, or sublicense the app (except where mandatory law allows), use it unlawfully, or attempt to disrupt or gain unauthorised access to the Service.

7. Your data and backups

Because your budgeting data is stored on your device, you are responsible for safeguarding it, including keeping your own backups. We are not liable for data loss from device failure, uninstalling, clearing app data, or factory resets. Device-level backups are governed by your device and Google settings, not by us. How we handle your account and subscription data is described in the Privacy Policy.

8. Acceptable use

You agree not to use the Service to violate any law, transmit malware, infringe intellectual property, harass others, share your account to circumvent device or subscription limits, or interfere with the Service’s operation or security.

9. Intellectual property

The Service, including its name, logo, design, and code, is owned by us or our licensors. These Terms grant you a licence to use it, not ownership. Your own budgeting data remains yours.

10. Disclaimer of warranties

The Service is provided “as is” and “as available”. To the extent permitted by law, we do not warrant it will be uninterrupted or error-free. Mandatory statutory warranty and guarantee rights you have as a consumer remain unaffected.

11. Limitation of liability

To the extent permitted by law:

  • We are liable without limit for damage caused intentionally or by gross negligence, and for injury to life, body, or health.
  • For slight negligence, our liability is limited to the extent permitted by applicable law.
  • We are not otherwise liable for indirect or consequential damage, lost profits, or for data loss where you failed to keep reasonable backups (Section 7).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

12. Termination

You may stop using the Service at any time by uninstalling the app, and you may delete your account (see Delete Your Data). Note that uninstalling the app does not by itself cancel your subscription — cancel it in Google Play to stop future charges. We may suspend or terminate access if you breach these Terms. If we end your subscription for a reason that is not your serious breach, we will refund any pre-paid period you have not yet used, on a pro-rata basis (processed through Google Play). Sections that by nature survive (IP, liability, governing law) survive termination.

13. Website

Use of the spriglyapp.com website is also subject to these Terms. We may change or discontinue website content at any time. The website may link to third-party sites (e.g. Google Play); we are not responsible for their content.

14. Governing law and jurisdiction

These Terms are governed by the laws of the country in which the provider is established, without regard to its conflict-of-law rules. Mandatory consumer-protection rules of your country of residence remain unaffected. As a consumer, you may also bring claims in the courts of your residence.

We are not obliged and not willing to participate in dispute-resolution proceedings before a consumer arbitration board.

15. Changes to these Terms

We may update these Terms as the Service evolves. We will update the “Last updated” date and notify you of material changes.
